Arrests stay on an individual’s record until expunged. Section 609A.01 of the Minnesota Statutes provides the eligibility and procedures for expungement of arrest and criminal records. Expungements in Minnesota are automatic in certain cases, for instance, delinquency records (Section 609A.015), convictions based on mistaken identity (Section 609A.017), where the Board of Pardons grants a pardon (Section 609A.035), convictions for non-felony cannabis offenses (Section 609A.055). In other cases, a court order or grant of expungement is required. Where a court order is granted, the record subject may proceed to process the expungement of his arrest record.
