How Long Do Arrests Stay on Your Record?
In Nobles County, arrests stay on a person's record indefinitely by default and are accessible to those with the correct authorization. However, arrestees can have their arrest records expunged if they meet the eligibility criteria outlined in Minn. Stat. ch. § 609A.
Expunge Nobles County Arrest Records
Expungement is the sealing of a person's arrest record. It is not the destruction of the record but its removal from public view. The expungement process takes about 4 to 6 months. Nobles County District Court automatically expunges offenses covered by the Cannabis Act (Minn. Stat. § 609A.055) and those related to mistaken identity (Minn. Stat. § 609A.017). Individuals must meet the Minn. Stat. ch. § 609A provisions to qualify for full expungement in Nobles County. Eligible applicants must complete a Notice of Hearing and Petition for Expungement Form and the Order Concerning Sealing / Expunging Records (EXP105, EXP106, or EXP107). They must serve the completed forms on relevant agencies like the Minnesota Bureau of Criminal Apprehension, the Attorney General's Office, the local police department, the prosecuting attorney, the Nobles County Sheriff's Office, the Nobles County Attorney, and the Nobles County Department of Corrections (probation). The service must be done within 63 days before the scheduled hearing date. Afterwards, the petitioner must file the completed forms with the Nobles County District Court Administrator's Office and pay the filing fee of $295. The filing fee is waived for petitioners who were acquitted, were not found guilty, did not plead guilty in the case, or were exonerated under Minn. Stat. § 590.11. At the expungement hearing, the judicial officer will review the applicant's petition and information presented by relevant agencies and case victims and make a decision to grant or deny the request. The judicial officer will sign an expungement order if the expungement is granted. The court administrator's office will send a copy of the order to all relevant agencies, who have 60 days to appeal the order. If no appeal is filed, the petitioner's arrest record will be sealed 60 days after the filing of the order.
Nobles County Arrest Warrants
Under Minnesota Criminal Procedure Rule 3, a judicial officer will issue an arrest warrant if the facts in a complaint, supporting documents, or supplemental sworn testimony establish probable cause to believe a defendant has committed an offense. Nobles County District Court judges can issue arrest warrants. The warrant must contain the judge's signature, the defendant's name, or a description if the name is unknown. It must describe the offense committed by the defendant, the bail amount, and other conditions of release. The judge will combine the arrest warrant and complaint in one form. The arrest warrant must direct that the defendant be brought immediately before the issuing court. However, if the court is not in session, the defendant must be brought before the court within 36 hours after the arrest, exclusive of the day of arrest.
An authorized officer must execute all arrest warrants issued in Nobles County. The warrant may be executed anywhere in Minnesota and is effective upon the defendant's arrest. A warrant issued for a misdemeanor crime must not be executed on Sunday or any other day of the week between 10:00 p.m. and 8:00 a.m. except otherwise stated on the warrant. An authorized officer can execute an arrest warrant anytime if the person is found on a public highway or street. The officer doesn't need to have the warrant in possession when the arrest occurs, but the officer should inform the defendant of the warrant's existence and the charge.
Do Nobles County Arrest Warrants Expire?
Nobles County arrest warrants never expire. They will remain outstanding until resolved or executed. An authorized officer can arrest the defendant anytime and anywhere in Minnesota. Therefore, anyone with a warrant issued in their name should seek to resolve it as soon as possible.
