If the prosecutor agrees to the expungement, the prosecutor and attorney general's offices will work together to have the records expunged without the need for a court hearing.
Applicants whose arrest records did not result in a conviction and who do not have a gross misdemeanor or felony in the country in the past 10 years, can apply for expungement without bringing a Petition for Expungement. Instead, they should apply to the local arresting agency (and all law enforcement agencies with records of the arrest) in writing to destroy the identifying parts of the arrest record.
